Rental Terms & Conditions
Thank you for choosing to rent 1502 Cascades Drive, Unit 1,
Steamboat Springs, Colorado. Here are the terms and conditions for your stay as
renters at 1502 Cascades Drive Unit 1, Steamboat Springs, Colorado.
If you have not already paid it, the initial payment (50% of
the total) to secure the reservation is due within three (3) mail-delivery days.
You may deposit this payment directly into one of the two bank accounts specified
below or send it via Federal Express or UPS delivery, whichever is more convenient
for you. IMPORTANT: If you deposit the money directly into the account at a branch
of the bank, please write the name of the person making the reservation (your name)
and the dates of your stay on the deposit slip. Please send an email to
meingalls@post.harvard.edu indicating where you have deposited the money (the bank),
how you have deposited it (directly, by FedEx, or by UPS), the amount, and the dates
of your stay.
The remaining 50% is due 60 days prior to arrival unless we are
already within 60 days of your arrival, in which case the entire amount of rent and
taxes is due now (meaning within three (3) mail-delivery days).
The damage deposit of $750.00 is due 60 days prior to arrival
unless we are already within 60 days of your arrival, in which case the damage deposit
is due now. The damage deposit is fully refundable if there is no damage and the
townhouse does not require excessive cleaning.
Cancellations: Should you fail to utilize this confirmed reservation,
we retain all funds received, other than damage deposit, as liquidated damages unless
you or we are able to re-rent the unit for the same time period. If the latter occurs,
we will refund you the amount you paid or the amount we received for the re-rental
(whichever is LESS) minus a $150.00 administrative fee.
Payment Options: Please deposit funds for rent, taxes, fees and
security deposit directly into one of the following two bank accounts. Please include
your name and dates of stay on the deposit slip:
Washington Mutual Bank: Account # 3091846483 in the
name of Nice Utah Homes, LLC OR
US BANK: Account # 125215010393 in the name of Melville Ingalls
If you prefer to mail in your payment, please write the name
of the person who made the booking and the dates of your stay on the check so that
we can attribute the payment to your booking, and send your payment to:

The damage deposit is fully refundable within fifteen business
days of termination of occupancy provided that real and personal property are in the
same condition as when occupancy commenced, and all terms and conditions described
herein are met.
Check-in is at 4:00 PM on the day of arrival, and check-out is at
10:00 AM on the day of departure. You may make arrangements to leave your baggage
in the garage ONLY. Early or late check in/check out may result in a $50.00 per hour
fee unless the Renter has made prior arrangements for late or early check out/in.
The Renter is liable for all replacements and repairs needed to attain the same
condition as when occupancy commenced other than normal cleaning and laundry of linens
which should take no more than six (6) hours of cleaning time. Additional time spent
cleaning will be charged to the Renter at $50.00 per hour.
If the Renter stains the carpet to such an extent as to
necessitate cleaning, then the Renter shall be responsible for the cleaning charges
by a professional cleaning service.
Renter agrees to not flush down the toilet any items that may
cause damage or blockage, including but not limited to tampons, diapers, toys or
sanitary pads or other foreign objects. Toilets are low-flush and can only handle
a reasonable amount of single-ply toilet paper at a time.
Renter agrees to turn down the heat to 55 degrees when leaving
the unit, and to close all windows and close and lock all doors. Further, tenant
agrees to take all kitchen trash out to the outside garage trash container when
leaving the premises.
Renter and their party and/or guests shall remove their shoes
when entering the unit. PLEASE DO NOT WEAR SKI BOOTS IN THE UNIT; take them off and
put them on in the garage or in the mud room between the living room and the garage.
Please leave skis in the garage as skis may cause damage inside the unit. Damage
caused by ski boots, skis or other ski gear will be charged to the tenant.
A staff person WILL likely stop by the unit during the
Renter’s stay during normal business hours. The Renter is aware and agrees
that ABSOLUTELY NO SMOKING, NO PETS, NO ADDITIONAL GUESTS without permission and no
loud parties are allowed, and that only up to three vehicles are permitted. There is
room for two average size vehicles in the garage, and two larger vehicles may be pulled
up to the outside of the garage door, with an overall limit of three vehicles. There is
no smoking in the unit and no pets. If pets are kept in the unit, an additional charge
of $75 per day will apply for the entire stay. Cleaning fees for removal of smoking
odor shall apply at $50 per hour.
There is a maximum of 12 overnight occupants. Special arrangements
may be made prior to arrival for up to 14 overnight occupants, at least two of whom
must be young children, if approved by the owner or manager. Such approval may result
in an additional charge. If additional overnight occupants are found to be in the unit,
the Renter shall be obligated to pay additional rent in the sum of $100 per night per
person above 12 people, for the entire stay booked, unless otherwise previously approved
in writing (which shall include email) by the owner or manager of the unit.
The Renter and all members of his/her party including his/her guests,
agree to indemnify and hold Melville Ingalls, his family, employees, contractors and
agents, and Fifico, LTD, LLC harmless from all liability, injury, loss or damage arising
from any nuisance, damage, or harm made or suffered on the leased premises or outside
the leased premise by the Renter, tenants, guests, and/or visitors from any carelessness,
neglect, or improper conduct of any persons entering, occupying or visiting the leased
premises.

There is a lock box on the door with keys for the front door and
the hot tub across the street, and there is a key pad on the garage door. The
combinations will be provided to you prior to occupancy.
Parking: You are permitted up to three vehicles. You will not be permitted to park more than
three vehicles on the premises. Moreover, overnight parking is not permitted on the street, and any vehicles left on the
street may be towed at the owner’s expense.
Shuttle: During ski season, there is a free shuttle to the
mountain which leaves about every five minutes or so. It picks up just outside
the unit. It is also available upon request, free of charge, for transportation
to and from the town of Steamboat Springs and the area around the mountain.
Hot-Tub Caution and Safety Tips:
Please do not consume alcohol and then go in the hot-tub, which
could be very dangerous to your health. Exercise caution in and around the hot-tub,
as the deck may be icy and/or slick. Do not allow children to be unattended in the
hot-tub at any time. Do not exceed 20 minutes in the hot-tub. Do not use the hot-tub
without a doctor’s permission if you are pregnant or have heart or other health
problems. Please leave the chemical floating dispenser in the hot-tub at all times
to maintain safe chemical levels, and put the cover back on when not in the tub.
Use the hot-tub at your own risk.
Please cover the hot-tub as soon as you are done with it so it stays warm.
Please bring your own lap-top to utilize the wireless high speed
internet service.
Unit furnishings and amenities are subject to change without
notice. This unit receives regular quality control inspections. Please do not remove
linen, dishes or other items from the unit. Guests are liable for additional charges
resulting from any damage, lost items or excessive cleaning.
This agreement shall not be assigned, nor the premises sublet
without the written consent of the owner or his agents.
As the Renter, you agree to maintain this property in as good
condition as I find it and agree to replace or pay for any loss, breakage or damage
to the satisfaction of the owner, manager or agents.
As the Renter, you expressly understand and agree that the owner
of said premises will not be liable for any damages or injury to tenant or other
occupants and their property from whatever cause arising from the occupancy of said
premises. I, the Renter, have carefully read this agreement and agree to be bound to
its terms and conditions.
Should any legal disagreement arise between the parties, Renter
agrees that all legal action shall take place in Colorado, and shall be in the form
of binding arbitration with AAA Arbitration. Prevailing party is entitled to legal
costs, filing fees and expenses.
As the Renter, you agree to vacate said premises upon the
termination of this agreement at the agreed-upon hour and date. I, the Renter, agree
to pay any additional costs or charges should I damage the property, have additional
guests, or violate any other term and condition of this agreement.
When agreed to by the tenant and accepted by the owner/manager, OR when the
full amount of rent, tax and fees is paid by the tenant and accepted by the owner/manager, this
shall constitute a rental agreement and contract.
By renting this unit, you agree to be bound by these Terms &
Conditions and understand that the party renting this property is also bound by
these Terms & Conditions.
